Copyright Complaint Guidelines

At HONOR CLUB, we aim to give our club members a platform to share and explore all things HONOR and beyond with free flow of ideas and creativity. We respect the copyright of rightsholders and do our best to keep HONOR CLUB safe and orderly. Accordingly, we comply with the Digital Millennium Copyright Act, 17 U.S.C 512 ("DMCA") and other similar laws as may be applicable in other countries.  

Copyright Takedown Notification

As a copyright owner or an agent thereof, if you believe your copyright-protected work was posted on HONOR CLUB without your authorization, you can submit a Copyright Takedown Notification to copyright@hihonor.com to request a content removal. Before you submit a Copyright Takedown Notification, please consider whether copyright exceptions, such as fair use, apply to the content. In many countries, exceptions allow the use of copyrighted works under certain circumstances without authorization. If an exception applies, then the removal request would be invalid.

Please be sure to submit a Copyright Takedown Notification with necessary information so we can process your request more effectively and quickly. Failure to include necessary information may result in your Copyright Takedown Notification being denied. The necessary information are as follows:

·       Your role: the owner of copyright-protected work or an authorized representative of the owner, such as agent, attorney, employee

·       Evidence of rights or authorization: such as a registration certificate of the work, a license agreement or any other documents or signed statements defining your role

·        description of copyright-protected work, and where possible include a copy or the location (e.g. URL) of an authorized version of the work

·        description and location (URL) of the reported infringing material

·         a statement that you have a good faith belief that use of the reported material is not authorized by the copyright owner, an agent of the copyright owner, or the law

·        a statement that under penalty of perjury the information in this notice is accurate and you are, or you are authorized to act on behalf of, the owner of the rights being infringed by the reported material

·        your contact information, such as email, telephone number, post address

·        your physical or electronic signature

Before submitting a copyright takedown notice, please note that an intentionally misleading or fraudulent notice may be held you liable for damages under applicable laws. And a copy of the Copyright Takedown Notification will be sent to the user who uploaded the material addressed in this notification.

We reserve the right to suspend, disable and/or terminate in appropriate circumstances the accounts of users of HONOR CLUB who are found repeatedly to infringe or are repeatedly claimed to infringe the copyrights of others, or for other related reasons.

Counter Notification

As user of HONOR CLUB who received a Copyright Takedown Notification, if you believe the removal to be in error or believe that you are authorized to use the content, you can submit a Counter Notification to copyright@hihonor.com to request a content restoration. You may also reach out to the Copyright Takedown Notification sender directly to request a retraction.

Please be sure to submit a Counter Notification with necessary information so we can process your request more effectively and quickly. Failure to include necessary information may result in your Counter Notification being denied. The necessary information are as follows:

·       your role: the owner of the reported material or an authorized representative of the owner, such as agent or attorney

·        description and location (URL) of the reported infringing material

·        evidence of an authorized use or copyright exception

·        a statement that under penalty of perjury you have a good faith belief that the reported material was removed or disabled as a result of mistake or misidentification

·        a statement that you consent to the jurisdiction of the federal district court in which your address is located, or if your physical address is outside of the United States, for any judicial district in which HONOR is located, and that you will accept service of process from the person who submit the Copyright Takedown Notification

·        your contact information, such as email, telephone number, post address

·        your physical or electronic signature

Please note that you may be held liable for submitting an intentionally misleading or fraudulent Counter Notification. 

A copy of the Counter Notification will be sent to the provider of the Copyright Takedown Notification. And please be aware of that a Counter Notification may not lead to a content restoration if the copyright owner chooses to file suit against you within 10-14days of receiving the counter notification.

HONOR respects the intellectual property rights of others and will do our best to protect such intellectual property rights, including by providing the copyright takedown mechanisms available under the law. However, please note that we are not in a position to adjudicate disputes between third parties. While you are within your legal rights to use the take down provisions provided under the law, and the relevant counter notification provisions, you remain free to negotiate with the other party or assert your rights in court to resolve this issue directly.
