Conditions of Participation for “HONOR MAGIC MOMENT MONTHLY CHALLENGE”

1 Scope of Application

1.1 By taking part in the competition, the participant accepts these conditions.

1.2 Participants shall comply with the Honor Platform Terms of use (https://community.hihonor.com/global/privacy/?type=1) for user submissions and/or uploads. Submissions that violate the applicable terms of use or guidelines shall be disqualified.

2 Organizer

2.1 The organizer of the competition is Honor Technologies  Co., Ltd. (herein: “Organizer”).

2.2 The competition is held on HONOR Community and the campaign page is [https://community.hihonor.com/global/gallery/challenge]. In case of any questions, suggestions or complaints relating to the competition, please contact communityteam@hihonor.com.

3 Eligibility for Participation

3.1 The competition is open to all persons who, at the date of entry, are aged 18 years or over.

3.2 The Organizer’s employees, their immediate family members, and employees of cooperation partners who are or were involved in creating or implementing the competition, are excluded from participation.

3.3 Participation is only possible on one’s own behalf and joint submissions are not allowed. There is a restriction on one entry per person per competition. In the event of multiple posts being received from the same account, the first entry only will be accepted.

4 Participation

4.1 Participation in the competition is free of charges and fees and does not require the purchase of goods and/or services.

4.2 The competition timeline is subjected to the time marked on the current competition details page. Submissions received outside of the Entry Period will not be considered.

4.3 During the Entry Period, the competition is open to all participants who upload videos/photos to our current competition page. All applicants need to be registered to HONOR Club to submit the entry.

4.4 The entry must be your own original work (see section 6.1 for further information). Modifying, enhancing or altering a third party’s pre-existing work does not qualify as your original work.

4.5 Submissions containing any defamatory, obscene, illegal, offensive, or any other comparably unsuitable material will be disqualified and withdrawn from the competition.

4.6 The Organizer accepts no responsibility for incomplete, incorrectly completed, lost or delayed entries to the prize draw or for any malfunctions or failures in the software that has been designed to maintain the participant’s details.

4.7 The Organizer reserves the right to exclude a participant who violates these Conditions of Participation, tampers with the competition, or makes false representations or statements that violate applicable law or infringe third-party rights. If a participant is excluded, prizes and benefits may be subsequently revoked and reclaimed. In this case, a new winner may be determined pursuant to the procedure in section 5.4.

4.8 Entries can uploads multiple sets of works to participate in the contest, and the organizer will choose the best performance works(see the criteria in section 5.3) for the final award selection.

5 Prize, determination, and notification of winner

5.1 The award for HONOR MAGIC MOMENT MONTHLY CAHLLENG includes Excellence Award, Pioneer Award, Most Potential Award, and People’s Choice Award is subjected

5.2 The Prize of the above-mentioned awards is subjected to the prize list marked on the current competition page.

5.3 Winner Selection Criteria:

5.3.1 Winners will be chosen based on the following criteria- Creativity, originality, and in accordance to the theme.

5.3.2 Winners of the Excellence, Pioneer and Most Potential awards are selected according to comprehensive performance of the works (likes, comments, and view amount) and HONOR Global Team.

5.3.3 People’s Choice Award is selected based on the work getting the most likes, and the creator didn’t gain the above-mentioned awards.

5.4 The winner will be notified via Message in the HONOR Community within 48 hours after the deadline and hereby give his/her consent to the disclosure of his/her name in the community.

5.5 The notified winner must accept the prize within 72 hours after receiving the notification of the prize by way of a Message in HONOR Community. If the winner fails to accept his/her prize within this period, his/her prize shall be forfeited.

5.6 The prize will be sent by the Organizer via post to an address provided by the winner.

5.7 The organizer will be responsible for any taxes or charges incurred in claiming the prize.

5.8 Prize is subject to availability and the Organizer reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Organizer’s control make it necessary to do so.

5.9 Compensation of the prize in cash, its exchange, or its transfer to another person is excluded.

5.10 The Organizer does not accept any responsibility if you are not able to take up the prize.

6 Intellectual property

6.1 The participant warrants that each of his/her submitted entries is free of third-party rights, in particular, free of copyrights, logos and other intellectual property rights (e. g. patents, trademarks, design rights, know-how, etc.), and that the participant has the right to grant a license to the Organizer pursuant to section 6.3.

6.2 The participant agrees to release, discharge, indemnify, defend and hold harmless the Organizer (including its affiliate, officers, employees, and agents) against any claim by any third party due to a breach of section 6.1.

6.3 By submitting entries to this competition, entrants accept that the organizer has the right to use their submissions for campaigns and product and brand marketing for two years for free, including but not limited to using submissions in network media, print media, printings, exhibitions, retail stores, roadshows, digital content, out-of-home media, and other marketing activities.

7 Data Protection

By submitting an entry, participants will provide their personal information which will be used and disclosed by the Organizer and its authorized agents for the purposes of competition administration and prize fulfillment. Personal information collected by the Organizer is subject to the Organizer’s Privacy Statement at: https://community.hihonor.com/global/privacy/?type=2

8 Miscellaneous

8.1 The Organizer’s decisions regarding all promotional matters will be final, and no correspondence will be entered into.

8.2 In the event of circumstances outside the reasonable control of the Organizer, or otherwise where fraud, abuse, and/or an error (human or technical) affects or could affect the proper operation of this promotion or the awarding of prizes, the Organizer reserves the right to cancel or amend these terms and conditions at any stage but will endeavor to minimize the effect to participants in order to avoid undue disappointment.

8.3 If any provision of these Conditions of Participation is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.

8.4 All legal relationships arising because of or in connection with these terms and conditions and the competition are governed by Chinese law and subject to the exclusive jurisdiction of the court of Futian District, Shenzhen.
