HONOR NEW LAUNCH CAMPAIGN TERMS AND CONDITIONS

Version Date: 13th September 2024

Introduction

This HONOR New Launch Campaign (“Campaign”) will run from 19th August 2024 4:00 PM (GMT+8) to 13th October 2024 11:59 PM (GMT +8) (“Campaign Period”). Honor Technology (Malaysia) Sdn Bhd (Registration No.: 202101003804 (1404103-P)) (“HONOR”) reserves the right to shorten or extend the Campaign Period at its sole discretion without prior notice.

Campaign Mechanism

1. Eligibility

To participate in this Campaign, the customer(s) (“Customer(s)”) must be:

(i) individual(s) residing in Malaysia; and

(ii) eighteen (18) years of age and above as of of 19th August 2024.

(i) This Subscribe & Win Prize event will run from 19th August 2024 12:00AM (GMT+8) to 5th September 2024 7:59PM (GMT +8) (“ Subscribe & Win Period”) on HONOR Website at https://www.honor.com/my/shop/new-launch/ and https://www.honor.com/my/events/honor-ifa .

(ii) Customer(s) who subscribed to the HONOR Newsletter during the Subscribe & Win Period will stand a chance to win the prizes below (“Subscribe & Win Prize”):

(iii) To stand a chance to win the Subscribe & Win Prize, Customer(s) must fill out the questionnaire set by HONOR and subscribe within the Subscribe & Win Period at https://www.honor.com/my/shop/new-launch/ and https://www.honor.com/my/events/honor-ifa . Eleven (11) winners for the Subscribe & Win Event shall be selected by HONOR. Decisions of HONOR shall be final and binding.

(iv) Each (1) Customer(s) with the same email and/or same identity information with HONOR Website or My HONOR App will be entitled to one (1) entry to win Subscribe & Win Prize.

(v) Winners of the Subscribe & Win Event will be notified via their email address or phone number (as submitted with HONOR Website or My HONOR App) as above winner announcement date.

(vii) The winners of “HONOR Magic V3 Watch Party Participation Opportunity” must respond and accept the participation opportunity within 24 hours of receiving notification. Failure to accept within this period will result in forfeiture of the opportunity, and a new participant will be selected from the remaining eligible entries; The prize “HONOR CHOICE Robot Cleaner R2” will be forfeited if the winner did not redeem or claim the prize within two weeks from the date of the contacting email being sent to the email address.

(viii) The Subscribe & Win Prize is not exchangeable for cash or other items and are non-transferable.

(ix) The Subscribe & Win Prize is not covered by any warranty of HONOR.

(x) The Subscribe & Win Prize is subject to availability and HONOR reserves the right to substitute the Subscribe & Win Prize with another prize of similar value.

(xi) This Subscribe & Win Prize Event is only available on HONOR Website and My HONOR App.

(b) RM300 Deposit Pre-order

(i) This RM300 Deposit Pre-order event (“RM300 Deposit Pre-order Event”) will run from 5th September 2024 9:00PM (GMT+8) to 12th September 2024 3:30PM (GMT +8) (“RM300 Deposit Pre-order Period”).

(ii) After paying RM300 deposit (“Deposit”), the pickup code will be sent via SMS and email. Customer(s) are required to provide the pickup code to the relevant pick-up store for verification to complete the purchase transaction of HONOR Magic V3 from 13th September 2024 10:00AM (GMT+8) to 20th September 2024 11:59PM (GMT +8).

Upon completing the purchase, Customer(s) will receive the following exclusive gifts:

*This 365-Day Screen Protection covers internal and external screen that is cracked, damaged, or broken during the course of normal use due to accidental collision, falling or dropping only.
During the 365-Day Screen Protection period:
(1) Within 180 days from purchase date, the user is entitled to one (1) time free of charge internal and external screen spare part replacement.
(2) Within 365 days from the purchase date, the user is entitled to additional one (1) time 50% off internal and external screen spare replacement.
(3) Please note that the Screen Protection is subject to a service labour fee of RM60 for each replacement.

(iii) The Deposit is not refundable and cannot be used for any models or products other than for the purchase of HONOR Magic V3 5G.

(iv) Each (1) Customer(s) with the same registered account and/or same identity information with HONOR Website or My HONOR App can purchase a maximum of two (2) units of HONOR Magic V3 5G during the RM300 Deposit Pre-order Event.

(v) The purchase terms and conditions and free gifts under this event may vary from different channels, kindly refer to the relevant stores for the applicable purchase terms and conditions before placing your order.

(vi) The Deposit is not refundable and cannot be used for any models or products other than for the purchase of HONOR Magic V3.

(vii) Any HONOR product(s) purchased during the Campaign Period shall be subject to the same terms as HONOR's standard warranty service terms as provided in HONOR’s Warranty Policy. In addition to the standard warranty, any HONOR product(s) purchased during this Campaign Period will be entitled to 1 Year Extended Warranty as per terms and conditions of the Service Terms and Conditions. For the selected HONOR products purchased during the Campaign Period that come with the 180 days Screen Crack Protection, please note that the 180 days Screen Crack Protection are subject to the HONOR’s Warranty Policy.

(viii) Customer(s) shall check on HONOR Website for any latest changes to the terms of HONOR’s Warranty Policy which may be updated from time to time by HONOR.

(ix) All free gifts under this Campaign are not covered by the standard warranty of HONOR, except for the following free gifts:
• HONOR SuperCharge Wireless Charger Stand (Max 100W) and HONOR Magic-Pen are both covered by 6 months HONOR standard warranty; and
• HONOR Watch 4 is covered by 1 Year HONOR standard warranty.

(x) All free gifts are available on a first-come-first-serve basis, while stocks last.

(xi) HONOR reserves the rights to change and/or replace any free gifts with another free gifts of the similar value.

(c) Full Payment Pre-order

(i) The Full Payment Pre-order event (“Full Payment Pre-order Event”) will run from 5th September 2024 9:00PM (GMT+8) to 12th September 2024 3:30 PM (GMT +8) (“Full Payment Pre-order Period”).

(ii) Customer(s) who purchased the HONOR Magic V3 5G and HONOR Magicpad2 during the Full Payment Pre-order Event from any of the channels listed below will receive the following free gifts:

(vii) Any HONOR product(s) purchased during the Campaign Period shall be subject to the same terms as HONOR's standard warranty service terms as provided in HONOR’s Warranty Policy. (ii) Customer(s) who purchased the HONOR New Products during the Open Sale Period will receive the following free gifts:

General

(i) The Customer(s) agrees and consents to HONOR for the use of any of the Customer(s) personal data for the purpose of participation in this Campaign in accordance with the applicable Personal Data Protection laws and regulations, to the extent that any personal data provided shall only be processed and be used by HONOR for a lawful purpose directly related to the running of this Campaign including but not limited to the purposes of promotional events, advertising, marketing and any administrative matters to facilitate the management of this Campaign.

(ii) By providing the personal data, the Customer(s) confirms that (a) he/she agrees and consents to the collection, processing and transfer of your personal data in accordance with the applicable Personal Data Protection laws and regulations; and (b) he/she has read, understood and agreed to be bound by Statement About HONOR Platform and Privacy and HONOR’s Marketing Activities Privacy Statement. The Customer(s) further agrees that HONOR and/or its agent and/or its third-party service providers may contact the Customer(s) by telephone, email or such other method in connection with this Campaign.

(iii) In the event that any prizes or free gifts are being given to the Customer(s)' having provided a false or mistaken identity or information, HONOR shall have the right to revoke the Customer’s eligibility for the said prizes or free gifts.

(iv) By participating in this Campaign, Customer(s) agree to be bound by this Terms and Conditions and HONOR’s decisions are final and binding. No correspondence or appeals will be entertained. HONOR reserves the right to the final and ultimate interpretation of this Campaign.

(v) In accepting any prizes or free gifts, the winners agree to participate and cooperate as required in all editorial activities relating to the Campaign. The winners agree to grant HONOR a perpetual and non-exclusive license to use such footage and photographs, voice, biographical information and/or statements, at any time or times, in all media types worldwide for advertising, trade, publicity and promotional purposes and the winners will not be entitled to any fee for such use.

(vi) HONOR assumes no responsibility for late entries due to any reasons including, but not limited to, network transmission failure.

(vii) HONOR shall not be responsible for any losses or damages directly or indirectly incurred by any party including the Customer(s) in connection or arising from acts or omissions or in any way related to this Campaign.

(viii) The Customer(s) agrees to discharge and release HONOR from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Campaign or the Customer’s entry in this Campaign.

(ix) The Customer(s) further agrees to discharge and release any third party which is related to and connected with this Campaign, including Facebook and other social media platform, from any liabilities and claims (including from breach of contract, tort, negligence, or any other cause of actions at law or equity) arising out of or in any way connected to this Campaign.

(x) Save where it is otherwise prohibited by the applicable laws, in no event shall HONOR be liable to any party including the Customer(s) for any claims relating to the Campaign and/or any activities operated by any authorized online and offline stores and any service providers appointed by them, nor shall HONOR be held responsible for any payment made by the Customer(s) to any authorized online and offline stores and any service providers appointed by them, or for the fulfilment of the sales transaction by such parties.

(xi) Without prejudice to the foregoing and save where otherwise prohibited by law:- (1) in no event shall HONOR be liable to any party including the Customer(s) for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, howsoever remote even if such losses were foreseeable or if HONOR was advised of the possibility of such damages; and (2) if HONOR is adjudicated by a local court of competent jurisdiction to be liable for any losses or damages arising out of or is in any way connected to this Campaign and any events therein, HONOR’s total liability shall in no event exceed RM50.00.

(xii) By participating in this Campaign and any events therein, the Customer(s) agrees to indemnify and hold HONOR and HONOR Group of Companies, their officers, directors, shareholders, predecessors, successors in title, employees, agents and representatives harmless from any claims, losses, damages, liability, claims or expenses (including any legal fees), suffered or incurred by HONOR due to or in any way arising from this Campaign.

(xiii) If Customer(s) are discovered to be using or have used improper means to participate in this Campaign and any events therein, HONOR reserves the right to cancel the eligibility without notice including without hesitation, the commencement of legal proceedings under the full extent of the applicable laws.

(xiv) Where any HONOR product(s) purchased during the Campaign Period is returned to HONOR in accordance with its standard return policy, all free gifts received for the purchase must also be returned together with the HONOR product(s).

(xv) HONOR reserves the right to modify or cancel the terms and conditions at any time without further notice.

(xvi) This Campaign and the terms and conditions herein shall be governed by the laws of Malaysia.
