Terms and Conditions: HONOR Talents Global Design Awards Competition

I The Organizer

This Competition is organized by HONOR Device Co., Ltd (Suite 3401, Unit A, Building 6, Shum Yip Sky Park, No. 8089, Hongli West Road, Xiangmihu Street, Futian District, Shenzhen City, Guangdong Province, China) (hereinafter referred to as "The organizer"), and supported by HONOR subsidiaries worldwide. The competition is held based on the principles of fairness, impartiality, and openness, to shortlist high-quality design works from all over the world, and we hereby set forth and implement the following terms. By entering this competition described below (the “Competition”) you (the “Participant”) agree to be bound by these terms and conditions (the “Terms and Conditions”), the competition rules, and the privacy terms. Any information or instructions published by the Organizer about the Competition form part of these Terms and Conditions.

II Eligibility

1. The Competition is open to the residents aged 18 and above, in all the countries and regions where HONOR is offering its products and services.

2. Employees or agents of the Organizer or any of its subsidiaries or their families or households or anyone professionally connected to this Competition are not eligible to enter.

III Competition Period

3. The Competition will open at 5:00pm (London Time) on 29 May 2022 and close at 4:59pm (London Time) on 7 October 2022 (“the Competition Period”).

IV Prize

4. The following Prizes shall be won by 77 winners, (each a “Prize” and together the “Prizes”):
（1） Global 1st Place
（2） Visual Communication Design Prizes
（3） Art & Technology Prizes
（4）Special Awards

*The above creation awards amounts are pre-tax.
Winners from the Chinese Mainland/Hong Kong China/Macao China/Taiwan China will be paid in Renminbi, while winners from other countries or regions will be paid in EUR with the exchange rate settled in real-time on the day the prize is paid. The prize money of participants from the Chinese Mainland will be paid and withheld by the Sponsor for personal income tax. For participants from other countries or regions. please handle the matter of personal tax on the prize money according to applicable laws and regulations. The winner's certificate (electronic version) will be sent to you via email.

5. The Prizes are non-transferable and may not be substituted by the winners. The Organizer may substitute a prize of equal or greater value for any Prize.

6. The winners will be announced in November via official website (https://www.honor.com/uk/honor-talents/2022/) The prizes will be delivered to the winner within 120 days.

V Entry to Competition

7. To submit work, Participants must have an HONOR ID and log in.

8. Participants need to ensure that their work is original and has not been publicized or published anywhere. The criterion for determining the winning Entry is: the best artistic performance, with an emphasis on creativity, uniqueness and talent.

9. Any works and the content which are submitted by the Participant as part of the Entry must adhere strictly to the following Content Guidelines for the Competition: a) The Content must not display the image or likeness of any person or any information about any person unless the Participant has obtained that person’s permission. b) The Content must not display any cruelty to any animal or person. c) The Content must not infringe any third-party intellectual property (including music copyright). d) The Content must not infringe the rights of, or be defamatory or libelous about, any person. e) The Content must be suitable for a person of any age to view and must fully comply with the law and all regulations. f) The Content must not contain or display any words or images which are considered, at the Promoter’s sole discretion, to be offensive, sexually explicit, rude, disparaging or otherwise inappropriate.

10. Participants need to ensure that their work is original and has not been publicized or published anywhere. This Competition will not accept entries that have won awards in other contests.

11. FOR SAFETY REASONS it is important that Participants do not include or reveal any personal information (e.g., name, contact details, etc.) in any Content.

12. Entries containing any Content that does not comply with the Content Guidelines will not be entered into the Competition and the associated submission will be deemed invalid.

13. Entries that are incomplete or damaged will be deemed invalid. No responsibility is accepted by the Promoter for lost, delayed, or damaged data which occurs during any communication or transmission of Entries.

14. The Promoter reserves the right at its discretion to disqualify Entries which it considers do not comply with these terms and conditions or any Participant who it reasonably believes has interfered with the fair running of this Competition.

15. The Organizer shall have the right, where necessary, to undertake all such actions as is reasonable to protect itself against fraudulent or invalid claims including, without limitation, to require further verification as to the identity, age, and other relevant details of a Participant.

16. Entries must be made by the Participant and must not be made through agents or third parties.

VI Winner Selection

17. Following the end of the Competition Period, all Entries will be reviewed by a panel of judges. The detailed information about the judge panel, please refer to https://www.honor.com/uk/honor-talents/2022/ The panel of judges shall review all Entries at the end of the Competition Period to determine the Entry which best meets the Winning Criteria.

18. The decision of the panel of judges shall be final. No correspondence or negotiation will be entered into by the Organizer concerning either the decision or the result.

19. The winners will be notified using the email address provided at the time of Entry required to submit the entry.

20. In the event that a winner or substitute winner is unreachable, ineligible, or fails to Claim the Prize in the time required, the winner or substitute winner shall forfeit their Prize and it will be awarded to the next Participant selected in accordance with these Terms and Conditions.

VII Use of the Entries / Content by the Organizer

21. The Organizer may publish Content produced by the winner on any of its websites or any social networking website any and all Content received by it in connection with this Competition at any time and for any reason.

22. All Participants hereby provide a non-exclusive, royalty-free, irrevocable, perpetual, transferable license to the Organizer to use the Content submitted for any purpose, including without limitation for advertising the Organizer’s products and services. The Participant hereby waives all moral rights they have in the Content submitted to the fullest extent permitted by law.

23. In particular, the Organizer and its affiliates shall have the following rights with respect to the winning Entries:
1) To perform or authorize any third-party to develop derivative works or products, such as secondary development of work into dials, themes, wallpapers, and reasonable and necessary editing of the work for use in peripheral products such as phone cases, phone backing films, laptop bags, canvas bags, watch straps, retail gifts, other HONOR products, etc.
2) Use or authorize any third-party to use the work or its derivative works, including but not limited to developing, reproducing, distributing, selling or using the work in any product or service for any commercial use in any way globally. At the same time, the above works can be used in any marketing/distribution scenarios for publicity (covering all media and all channels, including but not limited to Internet, mobile Internet, official website, mobile app, Twitter, Facebook, Instagram, TikTok, posters, EDMs and other dynamic and print channels, printed materials, exhibitions, retail stores, road shows, outdoor media and other event publicity).
3) You agree that the finalist or winning entry of this competition may be displayed on our partner channels, such as HONOR's official channel, "Theme", "HONOR Club", "HONOR Overseas Community", as well as other relevant placement channels of our partners.

24. Each Participant warrants that they are the person who created the Content submitted to this Competition and that all Content adheres to the Content Guidelines. The Participant shall indemnify the Organizer and hold it harmless from and against any losses, damages, liabilities, obligations, claims, actions and demands, including without limitation reasonable legal fees, arising directly or indirectly from any breach of warranty set out in this clause.

VIII Privacy and Data Protection

25. Other than as set out in these Terms and Conditions or for the purposes of operating the Competition, the details and information provided by the Participant when entering the Competition or claiming the Prize will not be used for any promotional purpose, nor shall they be passed to any third party.

26. The Participant hereby consents to such personal information being used for this purpose and confirms they agree with the Organizer’s privacy statement available at https://agreement.itsec.honor.com/asm/agrFile/getHtmlFile?agrNo=1101&country=global&branchId=0&langCode=en-us . The Participant may withdraw consent to such use of personal information by writing to the Organizer or by using the opt-out process outlined in the privacy statement.

IX Miscellaneous

27. The Organizer shall not be liable for any interruption to this Competition whether due to force majeure or other factors beyond the Organizer’s control.

28. The Organizer reserves the right, acting reasonably and in accordance with all relevant legislation and codes of practice, to vary the Terms and Conditions of this Competition.

29. The Organizer will not be responsible or liable for: (a) any failure to receive Entries due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions or entries; (c) any computer or communications related malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the control of the Promoter; or (e) any printing or typographical errors in any materials associated with the Competition.

30. By entering the Competition, the Participant agrees to release the Organizer from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Competition or with the acceptance, possession or use of any Prize (except death or personal injury caused by the Organizer’s negligence, for fraud, or otherwise as prohibited by law).

31. All Prizes are subject to current tax law in the local jurisdiction and may be considered to be a taxable fringe benefit to those who have participated and won under these Terms and Conditions. Winners are responsible for declaring, if applicable, the local currency equivalent cost of the Prize as earnings to the local tax authorities in the country that the Participant is resident.

32. This Competition shall be governed by the laws of the People's Republic of China, disregards its conflicting laws.
